2. Services Description

The specific scope of our consulting work and design deliverables for your property will be defined exclusively by a separate, fully executed written service agreement.

3. Project Estimates and Site Conditions

All landscape design and agricultural counseling estimates provided by our team are valid for 30 days. Final design or consulting costs may vary if hidden subterranean conditions or undisclosed zoning restrictions are discovered during our site assessment (e.g., massive rock formations, severe root entanglement, or dense Georgia red clay requiring specialized drainage plans). Any major deviations from the original landscape plan require a formal, written change order approved by the Client.

4. Financial Responsibility and Billing

Clients are strictly responsible for funding their projects according to the payment schedule outlined in their specific contract. 6. Scheduling and Excusable Weather Delays

The Company shall not be held liable for delays caused by factors beyond our reasonable control, specifically severe weather conditions (e.g., heavy rain creating muddy, unsafe conditions for accurate topographical surveying).

7. Jobsite Safety and Operations

During on-site landscape evaluations or agricultural surveying, Clients, their children, and their guests must maintain a safe distance from our surveying equipment and personnel at all times. All assessment tools and soil testing equipment provided by the Company are to be operated exclusively by our trained staff.

8. Customer Responsibilities and Underground Utilities

You agree to accurately identify property lines and authorize site evaluation work only if you are the legal owner of the site. Crucially, the Client is responsible for disclosing the location of all private underground utilities prior to any invasive soil testing, including septic fields, private irrigation systems, and private lighting wires. The Company is explicitly not responsible for damage to unmarked private subterranean lines. We will contact Georgia 811 for public utility locates as required by law if invasive soil boring is necessary for our landscape plans.

9. Limitation of Liability

The Company maintains comprehensive professional and general liability insurance. However, to the fullest extent permitted by law, our aggregate liability arising out of any landscape counseling or agricultural design project is strictly limited to the direct cost of the consulting fee paid to us. We are explicitly not responsible for pre-existing structural foundation issues, undisclosed Cobb County zoning violations by the property owner, or any indirect, incidental, consequential, or punitive damages.
