HUMMEL LANDSCAPING, INC. ("Company," "we," "our," or "us") provides these Terms and Conditions to govern your access to our website and our professional agricultural services, landscape counseling, and site planning operations. By authorizing a site evaluation, signing a landscape design proposal, scheduling a consultation, or using our digital client portals, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any part of these terms, you must not utilize our landscape consulting services.
By utilizing hummellands.com or engaging our landscape counseling services, you formally accept these Terms. These Terms override any prior oral or written agreements unless specifically amended by a signed commercial contract.
We provide comprehensive landscape counseling, agricultural planning, and property assessment services for residential and commercial clients. This includes, but is not limited to: 3D landscape architecture blueprints, soil health assessments, drainage planning, irrigation strategy, and horticulture consulting. The specific scope of our consulting work and design deliverables for your property will be defined exclusively by a separate, fully executed written service agreement.
All landscape design and agricultural counseling estimates provided by our team are valid for 30 days. Final design or consulting costs may vary if hidden subterranean conditions or undisclosed zoning restrictions are discovered during our site assessment (e.g., massive rock formations, severe root entanglement, or dense Georgia red clay requiring specialized drainage plans). Any major deviations from the original landscape plan require a formal, written change order approved by the Client.
Clients are strictly responsible for funding their projects according to the payment schedule outlined in their specific contract. Retainers or deposits are generally required before our landscape architects begin drafting custom blueprints or ordering soil testing kits. In accordance with state law, we reserve the right to apply a statutory mechanic's lien under Georgia law to the property for unpaid consulting fees, labor, or agricultural design materials.
The Client agrees to provide our landscape counselors, surveyors, and agricultural planners with safe, unobstructed access to the property during scheduled evaluation hours. The Client is strictly responsible for unlocking gates, securing pets, and clearing the assessment area of personal property prior to our arrival for site measurements and soil sampling.
While we strive to adhere to estimated consultation and design timelines, all outdoor agricultural planning and site evaluation dates are approximate. The Company shall not be held liable for delays caused by factors beyond our reasonable control, specifically severe weather conditions (e.g., heavy rain creating muddy, unsafe conditions for accurate topographical surveying).
During on-site landscape evaluations or agricultural surveying, Clients, their children, and their guests must maintain a safe distance from our surveying equipment and personnel at all times. All assessment tools and soil testing equipment provided by the Company are to be operated exclusively by our trained staff.
You agree to accurately identify property lines and authorize site evaluation work only if you are the legal owner of the site. Crucially, the Client is responsible for disclosing the location of all private underground utilities prior to any invasive soil testing, including septic fields, private irrigation systems, and private lighting wires. The Company is explicitly not responsible for damage to unmarked private subterranean lines. We will contact Georgia 811 for public utility locates as required by law if invasive soil boring is necessary for our landscape plans.
The Company maintains comprehensive professional and general liability insurance. However, to the fullest extent permitted by law, our aggregate liability arising out of any landscape counseling or agricultural design project is strictly limited to the direct cost of the consulting fee paid to us. We are explicitly not responsible for pre-existing structural foundation issues, undisclosed Cobb County zoning violations by the property owner, or any indirect, incidental, consequential, or punitive damages.

These Terms and Conditions and all landscape consulting contracts shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any legal disputes arising from our services must be resolved through good faith negotiation. If litigation becomes necessary, both parties consent to the exclusive jurisdiction of the state courts located in Cobb County, Georgia.
You agree to fully indemnify and hold harmless HUMMEL LANDSCAPING, INC., its landscape counselors, planners, and staff from any claims, damages, or liabilities arising from your failure to secure necessary Homeowner Association (HOA) architectural approvals for our proposed designs, or your failure to disclose private underground utilities. If any provision of these Terms is found by a court to be unenforceable, that specific provision shall be limited to the minimum extent necessary so that the remainder of these Terms shall remain in full legal effect.
